The First Step in Obtaining Social Security Disability Benefits

Although anyone can technically "apply" for Social Security Disability (SSD) benefits — having any real chance of success is dependent on having a medically documented injury, illness or mental impairment that has prevented you from working for at least 12 months, or is expected to do so.

Unfortunately, this is just the minimum threshold.

To actually succeed, the Social Security Administration's office of Disability Determination Services (DDS) must be satisfied that the disability or impairment you have is supported by the evidence you've provided and that it meets the criteria DDS has established for that particular condition. The DDS must also be satisfied that you are not just incapable of returning to your old job, but that you cannot do "other work" either.

In practical terms, this means that the majority of initial claims for Social Security Disability benefits are denied because of insufficient medical evidence, doctor's reports that are not carefully worded to conform the SSA's definitions or findings of the ability to perform some other type of work.

Our Indiana lawyer helps people appeal if their initial disability claim has been denied. In sum, we work hard for our clients. We put in the time and effort it takes to build the strongest case possible initially so that we can use the skills we've honed in litigation to win at the administrative level. This process may take some time, but rest assured that we will do everything we can to avoid unnecessary delays and keep the process moving forward.
